Welcome to OASYS. These Terms & Conditions (“Terms”) govern your access to and use of the OASYS platform, website and related Services (collectively referred to as the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

 

Eligibility

You represent and warrant that you are of a sound mind, of legal working age and fully capable of entering into binding contracts under applicable law. By accessing or using OASYS services, you confirm that you meet these eligibility requirements.

 

 

Accounts & Registration

• To access certain features, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
• You are responsible for maintaining the confidentiality of your account login credentials and for all activity under your account.

• Use OASYS for any unlawful, fraudulent, or unauthorized purpose.
• Attempt to disrupt, damage, interfere with or gain unauthorized access to OASYS systems, servers, networks, or related infrastructure.
• Reverse engineer, copy, or reproduce the Services except as expressly permitted by OASYS in writing.
• Upload, transmit, or share content that is harmful, offensive, defamatory or infringes upon the rights of any third-party, including intellectual property rights or privacy rights.

Subscriptions, Payments & Fees

• Access to OASYS modules requires a valid subscription. Subscription payment detailed can be can be accessed here.
• The Subscription fees are exclusive of Government taxes, levies, bank charges, and other related fees which must be borne by you. You agree to provide accurate payment information and pay all applicable fees in accordance with the selected subscription plan.
• Unless explicitly stated otherwise, all payments made for subscriptions, renewals, or other paid services are non-refundable.
• OASYS reserves the right to modify, discontinue or update any subscription plans, features, and pricing. Any such changes will be communicated to subscribers in advance and continued use of the service after such notification will constitute acceptance of the revised terms.

 

Intellectual Property

• All content, software, designs, logos, user interfaces, trademarks and other materials available on or through the OASYS platform are the exclusive property of OASYS. All rights not expressly granted under these Terms are reserved.
• Use of the OASYS platform does not grant you any ownership rights or licenses to OASYS’s intellectual property, whether by implication, estoppel, or otherwise, except as explicitly permitted by OASYS in writing.

 

Data & Privacy

• Your use of the OASYS platform is subject to our Privacy Policy (link here), which explains how we collect, store, and process personal data. By using the platform, you consent to the practices described in the Privacy Policy.
• You are responsible for all the content you upload, including ensuring you have rights to any data you store on the platform.

 

Marketing and Service communications

• By registering for or using OASYS, you acknowledge and consent that OASYS may use your contact information (including name, email, organisation, and role) to send you service-related updates, newsletters, promotional materials, product announcements, event invitations, and surveys.
• You may opt out of receiving non-essential marketing communications at any time by using the “unsubscribe” link in our emails or by contacting us directly at [email protected].
• OASYS may also use aggregated and anonymised data for marketing insights, trend analysis, and industry reporting, provided that such data does not personally identify you or your organisation.
• OASYS is committed to ensuring that all personal data collected and processed for marketing or service-related purposes is handled in full compliance with applicable data protection and privacy laws, including the Personal Data Protection Act (PDPA). Appropriate technical and organisational safeguards are in place to protect such data against unauthorised access, disclosure, alteration, or misuse.

 

Termination

• OASYS reserve the right to suspend or terminate your account or access to the platform at its sole discretion if you violate any of these Terms, related policies or any applicable law. Such suspension or termination may occur without prior notice if deemed necessary to protect the integrity, security, or operation of the platform.
• You may terminate your account or subscription at any time by contacting OASYS support at [email protected].
• Upon termination of your account, your access to the OASYS platform and associated data will be discontinued. Certain information may be retained for record-keeping, legal, or operational purposes in accordance with our Data Retention Policy.

 

Disclaimers

• The OASYS platform and all associated services, content, and materials are provided on an “as-is” and “as-available” basis, without any warranties of any kind, whether express, implied, statutory, or otherwise. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted and error-free operation.
• OASYS does not guarantee that the platform will be free from errors, defects, viruses, or other harmful components, nor that access will be continuous, secure, or available at all times.
• You acknowledge and agree that your use of the OASYS platform is at your sole risk, and OASYS shall not be liable for any loss, damage, or inconvenience resulting from such use.
• The platform may include links or access to third-party websites, services, or content. OASYS does not endorse or guarantee the accuracy, reliability, or safety of such third-party content.

 

Limitation of Liability

• To the maximum extent permitted by law, OASYS, its affiliates, officers, employees shall not be liable for indirect, incidental, or consequential damages including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of, or inability to use, the OASYS platform or services, even if OASYS has been advised of the possibility of such damages.
• OASYS’s Total liability for any direct damages arising from or related to your use of the platform shall not exceed the total fees paid by you to OASYS in the twelve (12) months immediately preceding the event giving rise to the claim.

 

Indemnification

You agree to defend, indemnify, and hold harmless OASYS, its affiliates, officers, directors, employees, agents, and licensors from and against all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the OASYS platform or services;
• Any content, data, or materials you upload, store, or transmit through the platform;
• Your violation of these Terms or any applicable law, regulation, or third-party rights;
• Any act of negligence, misconduct, or breach of contract by you.

 

Governing Law & Dispute Resolution

• These Terms and your use of OASYS platform shall be governed by and construed in accordance with the laws of Sri Lanka.
• Any disputes will first be attempted to be resolved via good-faith negotiation. If unresolved within 30 days, the matter shall be referred to the Courts of Sri Lanka, and the judgment of the court shall be final, binding, and enforceable in accordance with applicable law.

 

Changes to Terms

OASYS reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised “Effective Date” and communicated via email. Continued use of OASYS platform after such updates constitutes your acceptance of the updated Terms.
